Outstanding Tristan ! I look forward to your expert analysis, as a fellow attorney, you always make me smarter. Thank you for these talking points, it's really necessary to have this information in mind when we come across the "low information" people out there. The more we can dispel the disinformation, the better the chances of changing public perception (especially when it's polluted by the sewage of Fox "news"). I speak out a lot, I'm putting you on "speed dial" in case things go south 😉

"They haven't been brought back because they can't be brought back and if they have been brought back it's fake news because if they had been brought back trump could bring back Garcia and trump can't bring back Garcia because. . . . "

I’m horrified regarding what’s happening and the fact that we note know that the Trump administration is paying them to keep him and no one has asked the embassy to facilitate his return. Plus, there still has been no proof of life. I fear he’s no longer here to be returned. 😢

This whole discussion is pointless and a waste of time. You can. And he does.

No one will stop him. A judge stands up to try and they're mysteriously gunned down in their driveway. There's no way to enforce the law on a criminal president if he's really a criminal, because they've been made supreme by design and practice. A mob of bellowing rubes over-rides the two remaining branches of government. Nothing substantive has been done to counter them. Yet.

As this goes on, the mysteries will proliferate. But that's for another time.

But we will seek justice and accountability nonetheless, because to give up is to surrender the rule of law entirely.

The point of fighting fascism isn’t to win every battle. It is to stand courageously against the onslaught, which will encourage others to fight, too. We cannot and will not win every time, but they ultimately cannot defeat us if we stand strong together.

Therein the mysteries I mentioned. Less than 2% of the population resisted the East German Stasi in any way. One such dissident is now the curator of the Stasi Library in Berlin. When asked why people wouldn't resist, her answer was that question makes no sense. Ask why people DID resist.

The language, therefore attitudes are shifting. It's been a long while since I've seen anyone derisively declare an argument to be an instance of Godwin's Law. Who will be our 2%? It's a mystery at the moment.

2% of the total population of the US comes to about 6.5M people. That would be a very large and sprawling game of Whack-a-mole were it to get out of hand. And out of hand it must get.

Allow me to clarify. I didn't say that the protests, low polling and lawsuits were pointless. Yes, I agree they're having an effect (which is difficult to perceive clearly at the moment).

What is pointless is the outdated bleating that you "can't" ignore the law or the courts, as if they are solid barriers to behavior. The best description of how belief drives behavior is in "Sapiens" by Yuval Harari (brilliant, btw). Belief in the law and courts drives and bounds behavior... until the belief fails. Trump doesn't believe in them, we do. The question is can the belief of the many overcome the highjacked power of the state to bend us to Trump's will? Unknown, we're in the Find-Out phase at the moment.

The pointlessness resides in a pre-Trump belief that, somehow, the law and the courts were a hard barrier to criminal behavior, when they're not. It works great as long as everybody's signed up, but that's not what we've got. Don't we believe words matter? Saying something is a hard, real-world fact when it's not is imprecise and weak.

ALL of the people sent to that facility need to be returned for their Due Process rights. i read that post wwii, nazis received 30 days in which to obtain legal counsel and make their case. Thank you Tristan for naming this as Human Rights, International Law as well as American Jurisprudence issue.

Agreed! Thank you for your strong voice on this matter. It truly is an important topic. I hope Van Hollen from Maryland who is going to El Salvador will meet with success. Congressman Garcia and others have asked for a codell to allow them to go to El Salvador, but they're waiting on GOPComer to approve it.

People need to know that NONE others have been returned from CECOT!

El Salvador president is making money off this prisoner. Why would he give him back.? Just sad that real criminals are going untouched. Trump is a hypocrite. Everyday he’s committing crimes. He’s the one that should be in that prison. I would waste one wish on this.

Drilling down, who created the pick-up list that included Abrego Garcia, and the gay make-up artist, and some random women they couldn't care less about? These people were targeted. And now, it's the huge dog&pony show distracting us from the rest of what they plan to do to us. Someone, or a committee of Millerites, or Stephen Miller himself.... OK, I just answered my own question.

And yet if it weren't for the unsung hero at the DOJ that told the judge that ABREGO was picked up by accident, we likely would never know. I know he was reprimanded, but I hope he is ok. It would seem they never wanted us to know about this miscarrisge of justice.

I feel it was a very badly acted show intended to make Trmp look like as if it's out of his hands. It looked like either Smiller or Blondi cooked it up, with Trubio not helping the "play" by saying the courts have no say in the matter. The president conducts all foreign affairs matters, which to your point, would indicate it IS within Trmp's power to get him back, esply because of the $6M paid from the U.S. to El Salvador to take Abrego and others. But the play went on anyway.

Bukele: It's preposterous for me to smuggle a "terrorist" into the U.S. (unless Trmp asks me)

Trump: I'm not going to ask him to do that. Garcia is a citizen of El Salvador so I have no say in the matter. (But what happened to him being in charge of foreign affairs?)

And if it's true that 9 other deportees were able to be returned to the U.S. it should be able to happen for at least 1 more.

But imagine if the worst has already happened, God forbid. What would the Supreme Court do if that were the case? That would put them in a perhaps once in a lifetime scenario of having to rule on a case where at the orders of the POTUS a man was sent illegally, against a federal judges order, outside of the country to his ultimate demise and then what would happen? Besides being a huge tragedy what a CRIME and SCANDAL that would be. An illegal action that resulted in a man's death? If he was find immune, there would anarchy in the streets!

So maybe they feel this is their best chance for that possibility to never be discovered and if that's the case, Bukele would be keeping a very big secret for Trmp and would then have Trmp in his back pocket! Talk about an opportunity for blackmail!

Could the $6M be a bribe for, Bukele to stay quiet and also for participation in a photo op in the WH? It wouldn't be the first time Trmp had used money for a payoff and called it something else(!). And there was no evident reason for Bukele to visit the WH. None, unless Bukele was just there for the press questions. Trmp wasn't open to negotiating with Bukele. If he was and Bukele was simply not cooperating Trmp would have treated him more like Zelensky. And isn't THAT something? Bukele being treated better than Zelensky! Bukele wasn't coming here to bring Abrego. So what WAS the reason? I say it was for a poorly staged farce full of contradictions and ridulousness.

But hopefully, all is OK with Abrego and he'll be back soon, but NOT soon enough.

Did Congress authorize payment for holding these men deported to this El Salvadoran death camp by tRUMP? Why are we paying El Salvador millions instead of returning them to their country of origin if in fact they are in the country illegally? Technically, without due process, and without convictions for charges of gang violence, these men should not be held as prisoners.
