I just don't get it. Why are there so many people letting this vile POS off the hook time and time again. It's criminal. People are laughing at us. it's a joke, and it's not funny. The number of psychopaths in power is becoming increasingly visible. It's exhausting. We're all gonna pay the price for those of us not billionaires. I struggle daily to find faith in our systems.

To be honest with you I'm not up on NYS law - it's one of the most positivist intensive legal system imaginable - but I had been back in the 1990s and I'd have to research it: but back then if for example an officer was blanketed by immunity the state would pay damages and he'd have to pay back the state once leaving office ? I never did anything like that but considered trying it.

Judges are extremely protective of each other and of State officers as well. General Municipal Law procedure is rife with the possibility of abuse. I'm uncertain regarding the niceties. I don't know how it would work with a criminal prosecution tho. Do time after 4 years ? He'll probably get some country club set up anyway. Personally they should have busted him for simple theft of classified documents instead of making a spectacle of it - the guy absolutely thrives on spectacle. Big deal if Biden did the same thing, bust his ass too.

Considering the amount of time Trump spends playing golf, I don't see how he can validly argue that being in court interferes with his presidential duties. And you can be the president from jail. It's not easy but it can be done.

But some judges, sometimes, impose a stiffer sentence that they see fit, and within legal guidelines, right? Even if it falls beyond the range argued for by defendant and prosecutor?

Merchan has been given off-ramps, I agree. But he doesn't have to take them.

Merchan has some leverage which is fun to explore. He could and should throw the book at Trump for being guilty as charged in a case that is so profoundly insulting to the American public that he will make Donald answer for his crimes. Then, Merchan can offer words to the affect that since I’m suspending your sentence until after your term in office, I will consider your behavior in office as it relates to these charges - meaning your actions as a President will have an affect on final sentencing. Will you defend, honor and protect the Constitution? Will you stand for our nations laws and not act above them in office? Will you defend and honor all of our past and current treaties and agreements with other nations and allies? Will you defend and support those of us who are less fortunate in our society as you have promised? And will you at all times act in accordance with the office of the President of the United States? If these conditions are met in good faith then I will consider all of them at your time of sentencing. And if your behavior rises to an exemplary level, I will consider removing all charges. And with that, maybe our big man baby President-elect will be able to impress Judge Merchan unlike anyone else. It’s a fun dream, but here’s hoping!
