This all sounds like you expect the Reps and the tRump regime will follow directives from the courts. They will do no such thing. The solution is to try forcibly remove musk and the felon thug like the South Koreans did.

Thanks for the thorough commentary. Alas my hope is a fleeting feeling. Our SCOTUS is supremely corrupt.

Why not a major lawsuit over Musk?

He is exerting powers that are not in his authority

He is being given obviously social security numbers and data that he has no power or right to have

His, whatever it is dodge(sp) is not an official government agency

He has not been vetted

Nor approved by the house or senate

Why is no one filing a lawsuit over all of this ?

He has no right to treasury or HR information.

Otherwise if lawsuits don’t work, we know he is a ketamine abuser.

Right there should deny him clearance.

I can’t I am not a lawyer

Someone do this!

Musk is also here illegally.

Deport him and confiscate his billions

Names of the people who have been helping out on the internet

I can guarantee that they have no clearance

Nor does musk

Nor is his dodgy department legal

Arrest him. Nothing less will stop him.

Thank you, Tristan, for this legal primer, which is educational and, indeed, the long game. We must, as a country, do this in order to prevent the raiding of government funds from the billionaires. These actions must take place at every turn, impeding the cycle of greed. What worries me is will MAGAs recognize the inherent dangers to our rights and our Treasury? If not, we will file these cases and hope that over the long haul, they will recognize they are about to lose Social Security, Medicare, and Medicaid. As you said, it is the long game. Thank you, as always, for breaking down each component, in order that it may be digested more easily.

Excellent legal analysis and trailblazing as a path. I too look for a way to extract the country from the mass psychosis. https://open.substack.com/pub/hotbuttons/p/comes-a-time?r=3m1bs&utm_campaign=post&utm_medium=web&showWelcomeOnShare=true

Isn't it the duty of the House of Representatives to file impeachment charges?

It seems very clear to me that by pardoning the J6ers and letting Musk do whatever he wants, Trump has given aid and comfort to the enemies, exactly fulfilling everything needed to match the 14th Amendment Section 3.

"...having previously taken an oath, as a member of Congress, or as an officer of the United States, ... to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."

He is disqualified to be president, and should be removed before he pardons Elon.

Thank you for this helpful analysis and for everything you’re doing to preserve democracy! In Robert Reich’s Stubstack today, he suggests that he “can think of at least 8 federal laws that have been broken by Musk and his goons over the last few days, and at least 2 provisions of the U.S. Constitution.”

Question: Are there any injunctions in the works to stop him?

Thank you!!

This legal approach has merit however, these processes take so long and the Trump regime is so very practiced at delay, defuse, distract that entire terms have passed with no legal action taken. Perhaps it's by design? A lot of damage can be/has been done as a result.

Delay is their #1 strategy. They pass laws and orders regardless of legality, just so they can have what they want for the time it takes to make a legal protest.

Well explained Tristan. The importance of TROs is critical to understand.

Meanwhile they crash the economy, steal all our personal info, convert the Treasury to blockchain, and enforce it all with pardoned J6ers.

If we protest, he declares martial law (he's waiting for that). Otherwise, he doesn't care what he breaks, because his friends Putin, Xi, and Orban want him to be just like them.

Wanted to share this piece I put together with you—it’s about how the Democratic Party can’t afford to sit on the sidelines for the next four years and why they need to take control of the narrative now. It lays out a strategy for a Democratic shadow government and how it could be the key to winning back Congress in 2026 and the White House in 2028.

Would love to hear your thoughts when you have a minute.

You understand, you are actually promoting fascism and tyranny? All because you disagree with somebody now that is not very democratic of you.
